Vendor Liability & Disclaimer

E-Book Shop Marketplace

This Vendor Liability & Disclaimer governs the allocation of responsibility between E-Book Shop and vendors offering digital products through the E-Book Shop Marketplace.

By registering as a vendor, you acknowledge and agree to the terms set out below.

1. Independent Vendor Status

All vendors on the E-Book Shop Marketplace operate as independent third-party sellers.
E-Book Shop does not create, own, control, endorse, or guarantee vendor products unless explicitly stated otherwise.

2. Vendor Responsibility for Products

Vendors are solely responsible for:

The accuracy, quality, safety, and legality of their digital products
Product descriptions, representations, and marketing claims
Compliance with copyright, licensing, and intellectual property laws
Ensuring products are fit for purpose and as described

E-Book Shop is not responsible for vendor-created content.

3. Consumer Protection Act (CPA) Compliance

Vendors acknowledge that they are the supplier for purposes of the Consumer Protection Act, 68 of 2008.
Vendors are responsible for:

Honouring CPA obligations
Handling consumer complaints, refunds, or remedies where applicable
Providing clear disclosure of digital product limitations

Nothing in this disclaimer limits consumer rights under the CPA.

4. Limitation of Platform Liability

To the maximum extent permitted by law:

E-Book Shop is not liable for losses arising from vendor products
E-Book Shop does not guarantee uninterrupted access to vendor content
E-Book Shop is not liable for incompatibility, performance issues, or user misuse

Use of vendor products is at the customer’s own risk.

5. Indemnification

Vendors agree to indemnify and hold harmless E-Book Shop, its directors, employees, and affiliates against any claims, damages, losses, or legal costs arising from:

Vendor products or services
Copyright or intellectual property infringement
Breach of law, CPA, or POPIA
Misrepresentation or negligence

6. Technical & Platform Disclaimer

E-Book Shop does not warrant that:

The marketplace will be error-free or uninterrupted
Vendor files will be free from bugs or compatibility issues
Customer devices or software will support vendor products

Technical issues may occur despite reasonable safeguards.

7. Removal of Content

E-Book Shop reserves the right to:

Suspend or remove vendor content at any time
Disable vendor accounts for policy breaches
Cooperate with legal authorities where required

Such actions may occur without prior notice where necessary.

8. Data & POPIA Compliance Disclaimer

While E-Book Shop implements reasonable security measures, vendors remain responsible for:

Lawful handling of any customer data they access
Compliance with POPIA and data protection laws

E-Book Shop is not liable for vendor misuse of personal information.

9. No Partnership or Agency

Nothing in this policy creates a partnership, agency, or employment relationship between E-Book Shop and any vendor.

10. Governing Law

This Vendor Liability & Disclaimer is governed by the laws of the Republic of South Africa, and disputes shall be subject to South African courts.
