Vendor Copyright & Intellectual Property Policy
E-Book Shop Marketplace
This Vendor Copyright & Intellectual Property Policy (“Policy”) governs the ownership, use, protection, and enforcement of intellectual property rights relating to digital products offered on the E-Book Shop Marketplace.
By registering as a vendor, you agree to comply with this Policy.
1. Vendor Ownership of Content
Vendors retain full ownership of their original intellectual property submitted to the E-Book Shop Marketplace, including eBooks, digital files, text, images, audio, video, and other creative materials, unless otherwise agreed in writing.
2. Vendor Warranty of Rights
Vendors represent and warrant that:
- They own all intellectual property rights in their products or
- They hold valid licences or permissions to distribute such content
- Their content does not infringe any third-party copyrights, trademarks, moral rights, or proprietary rights
False claims of ownership are strictly prohibited.
3. Licence Granted to E-Book Shop
By uploading content, vendors grant E-Book Shop a non-exclusive, royalty-free, worldwide licence to:
- Host, store, display, market, promote, and distribute the content
- Use vendor trademarks, logos, and product descriptions for promotional purposes
- Format or adapt content solely for technical or platform compatibility
This licence remains active for the duration the content is listed on the marketplace.
4. Prohibited Content
Vendors may not upload:
- Pirated, plagiarised, or unauthorised content
- Public-domain material falsely claimed as proprietary
- Content violating copyright, trademark, or trade secret laws
- AI-generated content that infringes third-party rights
E-Book Shop reserves the right to remove prohibited content immediately.
5. Digital Rights Management (DRM)
E-Book Shop may apply DRM, watermarking, or other security measures to vendor content to:
- Prevent unauthorised copying or distribution
- Identify the source of leaks or piracy
Vendors consent to such measures.
6. Infringement Complaints & Takedowns
E-Book Shop operates a notice-and-takedown procedure.
Upon receiving a valid infringement notice:
- The content may be removed or disabled
- The vendor will be notified where legally permissible
- Repeat offenders may have their accounts terminated
E-Book Shop may cooperate with rights holders and legal authorities.
7. Indemnification
Vendors agree to indemnify and hold harmless E-Book Shop against any claims, damages, losses, or legal costs arising from:
- Copyright or IP infringement
- Breach of warranties under this Policy
- Unauthorised use of third-party content
8. Trademarks & Branding
Vendors must not:
- Use E-Book Shop trademarks without permission
- Misrepresent affiliation or endorsement
- Use confusingly similar branding
All E-Book Shop branding remains the exclusive property of E-Book Shop.
9. Moral Rights
Where applicable, vendors waive or agree not to assert moral rights to the extent permitted by law, solely to allow lawful use and formatting of content on the platform.
10. Consequences of Violation
Violations may result in:
- Immediate content removal
- Suspension or termination of vendor accounts
- Forfeiture of unpaid earnings
- Legal action or referral to authorities
11. Governing Law
This Policy is governed by the laws of the Republic of South Africa, including the Copyright Act, 98 of 1978.
12. Policy Updates
E-Book Shop may amend this Policy from time to time. Continued use of the marketplace constitutes acceptance of updated terms.
